Discuss the powers and functions , position of the Chief Minister of any state in India?
Powers and Functions of the Chief Minister:
The powers and function of Chief Minister under the following heads:
1. The leader of the legislative Assembly:
The chief minister is the leader of the legislative Assembly of the state. On his advice the Governor exercise his functions in Matters like summoning,proroguing morning or if necessary dissolving the legislative Assembly. As chief spokesman of the state government,he explain the government policies in the matter of determining the internal policy of the State, decision of the chief minister is final. He comes to the rescue of a Minister if he face any difficulty during the debate in the Assembly he has to bear the responsibility of getting the important bill passed.
2. The Leader Of The Council Of Ministers:
Chief Minister is generally described as" first among equals". But these description is not a correct one. The constitution virtually give a pre-eminent to the leadership of the Chief Minister by placing him 'at the head' of the council of ministers.The Governor appoints or dismisses other ministers on his advice. The chief minister allocate or re-allocate the portfolio among the Ministers . The responsibility for maintaining unity and integrity among the member of the council of minister lies mainly with him. If Chief Minister resigns, the entire Council of Ministers is bound to resigns. So, in case of necessity , he try to keep the council of minister under his control by brandishing the threat of resignation.
3. The Leader of the Majority Party or Alliance:
It is the leader of the majority party or alliance in the Legislative Assembly from the Governor appoints the Chief Minister. He has to lead the party in and outside the Assembly and to see that the image, popularity, integrity and discipline of the party are maintained. He is always active to reconcile the policy of the party for the alliance with that of the Government.
4. The chief advisor to the Governor:
The chief minister is the chief advisor to the Governor. Generally, the Governor exercise all his functions on the advice of the Chief Minister. Beside he has to act as the principal channel of communication between the Governor and Council of Ministers. It is his duty to communicate to the Governor all decisions of the Council of Ministers.
5. Miscellaneous functions:
It an important function of the chief minister to maintain contact with people at large. He has to keep a watchful eyes on the public opinion at the time of formulating government policy and performing his functions. He discusses the problems and issues of the state and try to form public opinion in support of his party or alliance through his speech in the radio, the TV, public meeting etc.
Position Of The Chief Minister
In view of the all-pervasive powers of the Chief Minister many regards him as the 'real rural'of the state ,because on his aid and advise the Governor exercises powers.But according to others armed with his discretionary powers, the Governor can disregard the advice of the chief minister and thehe Council of Ministers. Thus,after the fourth general election the Governor of the different states toppled ministers by exercising their discretionary powers. Again , the Governor can even punish the recalcitrant council of minister by recommending to the president the imposition of state Emergency due to the failure of constitutional machinery in the state . So , Chief Minister of who belong to the party or alliance opposite to the ruling party or alliance at the centre has always to remember that the possibility of the application of the Governor's unlimited 'discretionary power' is hanging over his government just like the "The Sword of Democles".
